1. Legal independence
NearVisual (the Developer) is an independent studio specializing in software architecture, interface design and web technology consulting. The existing declaration describes its relationship with Candy Art Mérida as limited to technical services and website development.
It states that no employment subordination, business partnership, consortium or joint business ownership exists between NearVisual and Candy Art.
2. Commercial responsibility
The existing declaration releases the Developer from civil or commercial responsibility connected with transactions, sales agreements or services between Candy Art and its customers, including:
- Production timing, material quality and delivery of piñatas, headpieces, bows or personalized items.
- Quotes, financial agreements and cancellations arranged privately on WhatsApp or at the workshop.
- Accuracy, originality or legality of images, trademarks or text supplied by Candy Art for the catalog.
3. Technical architecture and maintenance
The declaration describes the website as developed using performance, security and technical-accessibility standards current at delivery. The Developer does not guarantee uninterrupted availability in the face of large network-provider failures, unforeseen connectivity events or unauthorized source-code changes by third parties.
4. Software ownership and licenses
The existing declaration states that the underlying programming logic, proprietary tools and modular web-design components created by the Developer remain owned by NearVisual, with Candy Art granted a legitimate commercial-use license for candyartmerida.com.
5. Governing law and disputes
The declaration is governed by applicable federal laws of Mexico. Technical or legal disputes about its scope are submitted to the competent courts of Mérida, Yucatán, Mexico.
