1. Purpose and scope
These terms govern access, browsing and use of the official Candy Art Mérida website, a workshop making piñatas, traditional floral headpieces, satin bows and themed custom creations in Mérida, Yucatán, Mexico.
By accessing the site, using exploration or customization tools or submitting a quote request, you fully and unconditionally accept these terms. If you disagree with any provision, refrain from using the site.
2. Handmade nature of the creations
The items shown in the digital catalog were made by hand in Mérida. Because they are individual handmade pieces, you acknowledge:
- Catalog and gallery images are photographs of real pieces previously made in the workshop and serve as visual references.
- Each new piece is made individually. Subtle variations in color, paper texture, foliage or modeled details may occur compared with the examples; they reflect handmade work rather than a defect.
3. Requests, references and quotes
The site is an interactive catalog and request-configuration assistant:
- Submitting a customization request generates a unique file reference in the format
CA-MMDD-XXXXX. - A reference or online request does not establish a completed sale or automatically reserve a date in the workshop’s calendar.
- The final cost, technical feasibility of specific materials and delivery dates are determined and agreed directly with the workshop through its official WhatsApp number, +52 999 279 0907.
4. Order confirmation and deposits
For an order to be formally scheduled, the following are required:
- Express confirmation from Candy Art on WhatsApp that the event date is available.
- Customer approval of the detailed quote and agreed final specifications.
- Verified payment of the applicable deposit, usually 50% of the agreed total or the amount stated in the workshop’s quote, through authorized methods.
The balance is due on physical delivery or before dispatch, as agreed with the workshop.
5. Changes, cancellations and refunds
Because items are personalized for each celebration:
- Design changes: changes to theme, color, size or wording must be requested and confirmed before cutting structures or buying specific materials. Later changes may produce extra charges or delays.
- Customer cancellation: for a confirmed order, the deposit covers expenses already incurred for materials, design and the reserved date. It is non-refundable if production has begun or reserving the date prevented other orders.
- Force majeure: if a workshop-related unforeseen event or force majeure prevents production, the existing terms provide for refund of the full deposit without additional penalties.
6. Reference images and intellectual property
- Customer materials: by supplying reference images, family photos or characters, you represent that you have the right or authorization to use them as creative references, releasing Candy Art from third-party copyright or industrial-property infringement claims.
- Workshop materials: photographs, videos and visual records of finished items taken by Candy Art belong to the workshop. The workshop reserves the right to show them in its catalog, portfolio and official social accounts while protecting customer privacy and identity.
7. Delivery and receipt
Items are usually collected at the Mérida workshop by appointment arranged on WhatsApp. If particular delivery or shipping is requested, conditions, charges and transport responsibilities are set in the individual quote.
The customer must inspect the finished item on receipt. Once the handmade item is delivered and accepted, workshop responsibility for subsequent handling, transport or care ends.
8. Liability and jurisdiction
Candy Art Mérida does not assume responsibility for delays or non-performance arising from natural disasters, weather, telecommunications failures outside the workshop or incorrect customer phone or event-date information.
Disputes arising from use of the portal or the handmade services are subject to applicable civil law and the competent courts in Mérida, Yucatán, Mexico, with waiver of other jurisdiction based on present or future addresses.
